No.1 Church Lane will be delivered with a 10-year Latent Defects Insurance policy, also known as liability insurance. This insurance is taken out by the developer for the benefit of the owners corporation and attaches to the building. This means the protection is intended to remain with the building for successive owners during the 10-year policy period. The policy is designed to provide an insurance-backed pathway for the owners corporation to have covered defects in critical common property building elements rectified for up to 10 years after the building is first occupied. These elements typically include the building’s structure, waterproofing and fire safety systems, together with any other elements covered by the final policy. Latent Defects Insurance is intended to operate as insurance of first resort. This means that, where a covered defect is identified, the owners corporation can make a claim under the policy without first having to establish fault through lengthy court proceedings.
